TendTag Terms of Use and Sale

These terms cover the TendTag Android app and TendTag NFC starter kits. They are offered by Lifestream Dynamics, a sole proprietorship at 465 Davis St, Sarnia, Ontario N7T 1C5, Canada ("we"). Questions: support@lifestreamdynamics.com.

Nothing in these terms limits rights you have under consumer protection law that cannot be waived, including Ontario's Consumer Protection Act.

1. The app

  • Buying it. TendTag is sold through Google Play. Google processes the payment, and Google Play's terms and refund policy govern the purchase.
  • Licence. Buying TendTag gives you a personal, non-transferable licence to use it on your own devices. You may not resell, redistribute or reverse-engineer it except where the law allows.
  • Your data stays on your phone. TendTag has no account and no network access. How it handles data is described in the TendTag Privacy Policy. Backups are files you export and keep; we cannot recover data we never receive.
  • Reminders are an aid, not a safety system. TendTag helps you remember upkeep. It does not monitor any equipment, and Android may delay or block notifications (for example under battery or exact-alarm settings). You remain responsible for maintaining and testing safety equipment such as smoke and carbon-monoxide alarms as the manufacturer and your local fire code require.
  • Tendies and the Mossling are in-app points and a companion feature. They have no cash value and cannot be bought, sold or transferred.

2. NFC starter kits

  • Compatibility. Kits work only with an Android phone that has NFC. They do not work with iPhone. Please check your phone before ordering.
  • What's in a kit is described on its listing. If a listing says a kit includes the TendTag app, you receive a Google Play promotional code by message after your order. Each code works once and expires on the date shown with it.
  • Price and payment. Prices are in Canadian dollars unless the listing says otherwise. Orders on Etsy are also subject to Etsy's terms. Orders on our site are paid through Stripe.
  • Shipping. We ship once a week from Sarnia, Ontario. The listing gives the handling time and destinations. Delivery dates are estimates.
  • Returns. You may return an unused kit within 30 days of delivery for a refund of the kit price. A kit that arrives damaged or defective will be replaced or refunded, including shipping; contact us with a photo. A promotional code that has already been redeemed cannot be refunded as part of a kit return.

3. Warranty and liability

The app and kits are provided as described in their listings. To the extent the law allows, we exclude other warranties, and our total liability for any claim relating to the app or a kit is limited to the amount you paid for it. We are not liable for indirect or consequential loss, including loss arising from a missed reminder. These limits do not apply where the law does not allow them.

4. General

  • These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
  • We may update these terms. The effective date at the top shows the current version; changes do not affect orders already placed.
